When
do you need a probate attorney?
When
someone dies, there is no legal requirement to use an attorney
to probate the estate. However, probate can be an emotional,
complex procedure, and court proceedings can be both intimidating
and confusing.
A probate attorney understands the law and legal principles
involved, and can help you prepare for court appearances,
assist you in preparing legal documents, and also help avoid
legal and tax complications.
A mistake or omission can seriously delay the probate process
or possibly expose the participants to liability.
The attorney's job is to act as an impartial 3rd
party, and to use his/her expertise and experience to help
resolve conflict.
